1. This agreement
These terms govern your use of the hosting, servers, domains and related services supplied by TisHost Ltd (“TisHost”, “we”, “us”). By placing an order, opening an account or using a service, you accept them.
If you are agreeing on behalf of a company, you confirm you are authorised to bind it.
2. Your account
You must give accurate registration details and keep them current. Notices about your services, including renewal and suspension notices, are sent to the email address on your account, so an address you no longer read is your risk.
You are responsible for everything done through your account. Keep your password private, and tell us promptly if you believe it has been compromised.
3. Orders, prices and renewals
Services are prepaid. An order is placed when you check out; the service is set up once the invoice is paid, not before.
Prices are shown in your account currency and include the taxes stated at checkout. We may change prices for future terms, and we will tell you before a change takes effect on a service you already hold.
Services renew for the same term unless you cancel before the renewal invoice falls due. Renewal invoices are raised in advance so you have time to decide.
4. Domain names
Domains are registered with a third-party registrar and are subject to that registrar's agreement and to the policies of the relevant registry and ICANN, including dispute resolution policies.
A registry charges us the moment a domain is registered, renewed or transferred, and that charge is not reversible. Domain fees are therefore non-refundable once the registration or transfer has been submitted, even if the request later fails at the registry.
You are responsible for renewing a domain in time. We send reminders as a courtesy, but a domain that lapses may be lost or may cost a redemption fee set by the registry.
5. Acceptable use
You may not use our services to store, send or link to material that is unlawful, or to interfere with anyone else's use of the network. The following are not permitted:
- Sending unsolicited bulk email, or hosting a site advertised by it.
- Phishing, malware, or content designed to deceive or defraud.
- Material that infringes someone else's copyright or trademark.
- Child sexual abuse material, or content that incites violence against a person or group.
- Attacks on other systems, including port scanning, denial of service and unauthorised access attempts.
- Activity that consumes shared resources so heavily that other customers on the same server are affected.
6. Suspension and termination
We may suspend a service without notice where it is being used in a way that breaks section 5, threatens the stability or security of our network, or exposes us to legal liability. Where the matter is not urgent we will contact you first.
We may suspend a service for non-payment after the invoice is overdue and we have written to you about it. Data on a suspended service is retained for a limited period and then deleted; do not rely on a suspended service as a backup.
You may cancel a service at any time from the client area. Cancellation takes effect at the end of the paid term unless you ask for it sooner.
7. Backups and your data
You own your data. We take backups for our own operational purposes and will restore from them where we reasonably can, but they are not a substitute for your own backups and we do not guarantee that any particular restore will be possible.
Keep your own copies of anything you cannot afford to lose.
8. Availability
We work to keep services available continuously, but no hosting service is available every minute. Planned maintenance is announced in advance where possible. Availability commitments, where we offer them, are stated in the service's own description and are your sole remedy for downtime.
9. Liability
Nothing in these terms limits liability that cannot lawfully be limited.
Otherwise, our total liability to you for any claim connected with a service is limited to the amount you paid us for that service in the twelve months before the claim arose. We are not liable for loss of profit, loss of business or loss of data.
10. Changes to these terms
We may update these terms. Where a change materially affects your rights we will give notice before it applies to your services. Continuing to use a service after that is acceptance of the revised terms.
11. Governing law
These terms are governed by the laws of Bangladesh, and the courts of Bangladesh have exclusive jurisdiction over any dispute arising from them.
